Terms and Conditions
Welcome to DRV Contractor!
1. Scope of Work
DRV Contractor will perform only the work described and approved in writing in the corresponding proposal or contract. Any service, material, repair, or modification not specifically included in the original scope of work shall be considered outside the project. The client is responsible for reviewing and confirming the scope of work prior to the start of the project.
Any changes requested after initial approval will be handled through a Change Order, which must be approved by both parties before execution. All additional work or scope modifications will result in additional charges, without exception. These charges will be calculated and presented to the client for approval before proceeding. DRV Contractor is not obligated to perform any work not included in the agreed scope.
2. Payments and Payment Schedule
The client agrees to make payments according to the schedule established in the proposal or contract. No work will be scheduled or started without the agreed-upon down payment. Payments must be made on the specified dates or project milestones.
Any delay in payments may result in delays to the project schedule and will not be attributed to the contractor. Additional work approved through a Change Order must be paid according to the terms outlined in that order.
DRV Contractor reserves the right to suspend work if payments are not made as agreed.
3. Materials and Client Selections
The client is responsible for selecting all materials required for the project, including finishes, colors, fixtures, and decorative elements. DRV Contractor may provide recommendations; however, final selection decisions remain the sole responsibility of the client.
Delivery times, availability, inventory changes, or product discontinuations by suppliers are outside the control of DRV Contractor. Delays caused by client-selected materials may affect the project start date or duration.
If the client chooses to change materials after they have been approved and/or purchased, any additional costs resulting from returns, replacements, price differences, delivery fees, or extra labor time shall be the client’s responsibility. DRV Contractor does not guarantee materials supplied directly by the client and is not responsible for defects, failures, or incompatibilities related to such materials.
4. Warranties
DRV Contractor provides a workmanship warranty for the period specified in the proposal or contract. This warranty covers only defects resulting from the installation or execution of the contracted work performed by DRV Contractor.
The warranty does not cover:
Normal wear and tear
Damage caused by misuse, accidents, or lack of maintenance
Failures in materials selected or supplied by the client
Structural issues or pre-existing conditions
Damage caused by moisture, leaks, plumbing, electrical systems, or other systems not included in the contracted work
Materials used in the project are subject to the manufacturer’s warranties. Any claims related to materials must be handled directly with the supplier or manufacturer. DRV Contractor does not provide warranties for additional work performed without formal approval or for temporary repairs requested by the client.
The client must notify DRV Contractor of any warranty claim in writing within a reasonable time to allow DRV Contractor the right to correct the issue (“Right to Cure”).
5. Property Access
The client must provide adequate access to the property during the agreed workdays and hours. The work area must be cleared prior to the start of work. Any additional time required to move furniture or personal items will be considered extra work.
The client is responsible for securing pets, personal belongings, and any items that may interfere with the work. If access to the property is restricted due to circumstances beyond DRV Contractor’s control, project timelines may be adjusted without penalty.
6. Site Conditions
The client must disclose any existing conditions that may affect the work. If hidden damage or unforeseen conditions are discovered, work may be paused to assess and determine the necessary steps.
Repairs resulting from such conditions are not included in the original scope of work and may result in additional costs. DRV Contractor is not responsible for failures caused by pre-existing conditions.
DRV Contractor does not test for or remove hazardous materials such as mold, asbestos, or lead-based paint. If such materials are discovered, work will be suspended and the client must hire a certified professional.
7. Permits and Regulations
The client is responsible for obtaining and paying for any required city or municipal permits unless otherwise agreed upon in writing. Delays caused by inspections, explanation, or municipal requirements are not the responsibility of DRV Contractor.
8. Subcontractors
DRV Contractor may use licensed and insured subcontractors to complete portions of the project. DRV Contractor will remain responsible for overall coordination of the work.
9. Liability and Insurance
DRV Contractor maintains general liability insurance covering incidents directly related to the work performed. The client is responsible for maintaining insurance coverage for the property during the project.
DRV Contractor is not responsible for damages caused by pre-existing conditions, structural issues, or outdated systems. DRV Contractor is not responsible for the loss of personal property not properly secured by the client.
DRV Contractor shall not be liable for indirect, incidental, consequential damages, loss of use, loss of income, or damages not directly caused by proven contractor negligence.
10. Safety and Compliance
DRV Contractor will perform the work following safety practices and in compliance with applicable codes. The client must keep work areas free of obstacles and avoid access to active work zones.
If coordination with a Homeowners Association (HOA) or other entities is required, the client is responsible for permits and additional requirements unless otherwise agreed in writing.
11. Project Photos and Documentation
DRV Contractor may take photographs before, during, and after the project for internal documentation purposes. Any use of photos for promotional or portfolio purposes requires written authorization from the client.
12. Cleanup and Waste Management
DRV Contractor will remove construction debris generated by the project and maintain an orderly work area. Final cleanup includes removal of leftover materials and construction waste only.
Deep cleaning, washing, polishing, or specialized cleaning services are not included unless agreed upon in writing. Removal of additional debris not related to the project will be considered an extra service.
13. Cancellations and Rescheduling
If the client needs to cancel or reschedule the project, reasonable advance notice must be provided. Costs already incurred will remain the responsibility of the client.
Rescheduling is subject to availability. DRV Contractor may reschedule work due to unsafe conditions or lack of access.
14. Intellectual Property and Proposals
All proposals, designs, estimates, and documents prepared by DRV Contractor are for the exclusive purpose of evaluating and executing the project. They may not be shared or used by third parties without written authorization.
All concepts and recommendations remain the intellectual property of DRV Contractor.
15. Lien Rights
In accordance with Washington State law, DRV Contractor reserves the right to file a lien against the property if agreed payments are not made.
16. Force Majeure
DRV Contractor shall not be held responsible for delays caused by events beyond its control, including but not limited to severe weather, supplier delays, emergencies, illness, strikes, or supply chain disruptions.
17. Final Payment and Project Completion
Final payment must be made upon completion of the work and before formal project delivery. The final walkthrough will be conducted with the client present.
Once final payment is received, the project will be considered closed. Any subsequent requests will be treated as additional work.
18. Dispute Resolution
Any dispute related to the project must first be communicated directly to DRV Contractor. If no resolution is reached, the parties may pursue mediation or arbitration in accordance with applicable state laws.
19. Acceptance of Terms and Conditions
By authorizing the proposal, submitting the down payment, or allowing work to begin, the client acknowledges that they have read, understood, and accepted these Terms and Conditions.
